These Terms of Service ("Terms") govern your access to and use of www.livingarchitecturelimited.org (the "Website") and any related content operated by Living Architecture Limited, a company incorporated under the laws of the Federal Republic of Nigeria with Registration Number 6977052 and registered office at 4B Joseph Amadi Close, UBA Road, Bera Estate, Lekki, Eti-Osa, Lagos State, and Port Harcourt address at 32 King Perekule Street, GRA Phase II, Port Harcourt, Rivers State ("Living Architecture", "Company", "we", "us", "our").

By accessing the Website, creating an account, or engaging Living Architecture for any service, you ("Client", "User", "you") agree to be bound by these Terms and our Privacy Policy, which is incorporated by reference. If you do not agree, you must not use the Website.

To create an account, use, or transact on the Website, you must be at least 18 years old and capable of forming a binding contract under Nigerian law, or have the permission of a parent or guardian. You agree to provide accurate, current, and complete information during registration and to keep it updated.

You are responsible for maintaining the confidentiality of your login credentials and for all activities under your account. Notify us immediately of any unauthorized use of your account.

Fees for services, purchases, deposits, instalments, or investment contributions will be specified in the applicable Agreement, invoice, or subscription form.

Refunds, cancellations, and forfeiture of deposits are governed by the specific terms of the relevant Agreement, given the bespoke nature of real estate transactions.

You agree not to:

• Use the Website for any unlawful purpose or in violation of these Terms;
• Provide false, misleading, or fraudulent information, including for KYC/AML verification;
• Attempt to gain unauthorized access to our systems, other users' accounts, or non-public areas of the Website;
• Introduce viruses, malware, or engage in any activity that disrupts the Website;
• Scrape, reverse-engineer, or reproduce Website content without our prior written consent;
• Impersonate any person or misrepresent your affiliation with any person or entity.

All content on the Website, including text, graphics, logos, designs, architectural renderings, and software, is owned by or licensed to Living Architecture Limited and is protected by Nigerian intellectual property laws. You may not reproduce, distribute, modify, or create derivative works from any part of the Website without our prior written permission, except for personal, non-commercial use directly related to an active engagement with us.

• Renderings, floor plans, and marketing images of developments are illustrative and may differ from the finished product; final specifications are governed by the relevant sale/purchase or construction agreement.
• Project timelines communicated on the Website are estimates and may be affected by regulatory approvals, weather, supply chains, or other factors outside our reasonable control.
• Title, survey, and land-use information will be made available through the formal transaction process and should be independently verified by your legal adviser before completion.

The Website may link to or integrate third-party services, including payment processors, mapping tools, and partner contractors. We do not control and are not responsible for the content, policies, or practices of third parties.

To the fullest extent permitted by law, Living Architecture Limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, or data, arising from your use of the Website. Our aggregate liability arising out of or related to these Terms and the Website (excluding liability under a separate Agreement, which is governed by its own terms) shall not exceed the amount paid by you to us for the specific service giving rise to the claim in the twelve (12) months preceding the claim.

You agree to indemnify and hold harmless Living Architecture Limited, its directors, employees, and agents from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your breach of these Terms, misuse of the Website, or violation of any law or third-party right.

We may suspend or terminate your access to the Website, with or without notice, if we reasonably believe you have violated these Terms, engaged in fraudulent activity, or for security or legal reasons. Termination of Website access does not affect obligations under any active engagement or Agreement, which survive according to their own terms.

These Terms are governed by and construed in accordance with the laws of the Federal Republic of Nigeria.

We may revise these Terms from time to time. The "Effective Date" above will reflect the most recent revision. Continued use of the Website after changes take effect constitutes acceptance of the revised Terms. Material changes will be notified to registered users.
